A building permit is not required for the installation of a fence unless the fence will be taller than (7) seven feet. The Rutherford County Register of Deeds office in Murfreesboro, 319 North Maple Street, Murfreesboro, TN will be able to provide you with the required plot plan copy should you need to submit for permit, which will illustrate any easements, property line dimensions, locations where property pins should be, etc. However the City of La Vergne does not survey property. Public right-of-way. Fences shall be prohibited on any street or public right-of-way. Easements. No fence may be placed within any section of a recorded public utility, drainage or detention pond easement. Sight distance limitations. No fence shall be placed on private property near an intersection and/or driveway entrance in a manner that creates a visual obstruction or safety hazard for vehicular traffic and pedestrians. Maintenance. All fences shall be maintained in a safe, structurally sound and upright condition, and present a uniform appearance so as not to constitute a hazard, blight or condition of disrepair. Examples of hazards, blight or conditions of disrepair shall include, but not limited to: leaning fences; fences that are missing slats, parts, or blocks; holes; breaks; rot; cracking or peeling paint; rust; graffiti; or other broken, damaged, or removed material. NOTE: Fences cannot enclose any utility meters. Permits will require a site inspection and may take longer to review and approve. We will strive to approve your permit as quickly as possible. Please plan ahead for your permit, some permits require a few days of review prior to issuing a permit. Do not encroach upon your neighbor’s property or an easement. Also, if you have subdivision covenants or member of a homeowners association these may require a property line setback or specific materials or review process. This is outside the City preview, but one you will want to check out in the front end.
