The permit will be issued for one (1) continuous move. The permit will be issued for the movement of one (1) house on steel beams and rubber dollies by towing truck within the City of LaVergne, LaVergne, Tennessee. The permit will be granted with the understanding that when traffic begins to accumulate behind, movement will pull over to allow traffic to pass. The permit is hereby revoked if road surfaces are affected by ice and/or snow. The moving contractor is responsible for any damages incurred during the move. I have read and understand the above requirements set forth: _____________________________________Print Name & Date __________________________________ Applicants Signature _____________________________________ _______________________ Codes Department Date ORDINANCE #2020-08 AN ORDINANCE TO AMEND THE LA VERGNE MUNICIPAL CODE BY AMENDING TITLE 16 BY ADDING A NEW CHAPTER 5 ENTITLED "MOVING OF HOUSES, STRUCTURES OR BUILDINGS" AND BY AMENDING TITLE 12, CHAPTER 1 , SECTION 12-103 REGARDING MISCELLANEOUS FEES. BE IT ORDAINED BY THE BOARD OF MAYOR AND ALDERMEN OF THE CITY OF LA VERGNE THAT: SECTION I. Title 16 of the La Vergne Municipal Code be amended by adding a new Chapter 5 that reads as follows: CHAPTER 5 MOVING OF HOUSES, STRUCTURES OR BUILDINGS SECTION 16-501. Permit Required. 16-502. Application, fees, and insurance. 16-503. Restrictions on the movement of houses, structures or buildings. 16-504. Appeal. 16-505. Enforcement. 16-501. Permit required. It shall be unlawful for any person to move any house, building or structure over, along or across any highway or street in the city without first obtaining a permit from the Codes Department. The permit shall be reviewed by the Building Official and the Police Chief and shall be approved by them or their respective designees. 16-502. Application, fees, and insurance. A person seeking issuance of a permit shall file an application for such permit. At a minimum, the application shall set forth: 1) The kind and type of building to be moved; 2) The address of the final destination of the building; 3) The length, height and width of the building; and 4) The highways and streets over, along or across which the building is proposed to be moved. The application shall be accompanied by a nonrefundable permit application fee in the amount of fifty dollars ($50). The Police Chief may direct that city provide a police escort in front of and behind the oversized load as it moves through the city to accompany the movement of the structure to protect the public from injury. The city shall be paid a fee of two hundred dollars ($200.00) per hour for the escorts, with a two hundred dollar ($200.00) minimum charge. The application shall be accompanied by a liability insurance policy issued by an insurance company authorized to do business in the State of Tennessee and approved as to form by the city attorney in an amount not less than $50,000. This insurance policy shall Page 1 of 3 be called upon if there is any damage done to any city property due to the moving of the building. 16-503. Restrictions on the movement of houses, structures or buildings. No house, structure or building exceeding a maximum length of forty (40) feet or a maximum width of eight (8) feet, shall be towed or otherwise moved over, along or across any highway or street between the hours of 7:00 a.m. and 9:00 a.m. or between 4:00 p.m. and 6:00 p.m. Notice shall be given to the La Vergne Police Department at least 24 hours in advance. The applicant shall furnish escorts. The Police Chief may direct that the oversized load shall be moved after 10:00 p.m. to minimize the effects on traffic. 16-504. Appeal. An appeal to the board of mayor and aldermen may be taken by any person, firm or corporation aggrieved, or by any governmental officer, department, board or bureau affected by any decision of the city based in whole or in part upon the provisions of this chapter. Such appeal shall be taken by filing with the board of mayor and aldermen a notice of appeal specifying the grounds thereof. The board shall place the appeal on the agenda of its next regularly scheduled meeting and give public notice thereof, as well as due notice to the parties in interest to appear. The decision of the board is final. 16-505. Enforcement. The building official and the chief of police shall enforce and carry out the requirements of this chapter. Notwithstanding the filing of a liability insurance policy, the permittee shall be personally liable for any expense, damage or costs, and the city attorney shall prosecute an action against the permittee in a court of competent jurisdiction for the recovery of such amounts. SECTION II. Title 12, Chapter 1, Section 12-103 of the La Vergne Municipal Code be amended by removing the words "House Moving Permit $150" from Miscellaneous Fees. SECTION III. Each section, subsection, paragraph, sentence and clause of this ordinance is hereby declared to be separable and severable. The validity of any section, subsection, paragraph, sentence or clause shall not be effected by the invalidity of any other portion of this ordinance, and only any portion declared to be invalid by a court of competent jurisdiction shall be deleted herefrom. SECTION IV. That this Ordinance take effect forthwith upon its final passage, the public welfare requiring it.
